Lawton R. Nuss, former chief justice of the Kansas Supreme Court, accepted the invitation from the Tribal Law and Policy Institute of Los Angeles to make presentations on veterans’ treatment courts.  His most recent program was presented in Phoenix at the 56th Annual National Tribal Judicial and Court Personnel Conference sponsored by the National American Indian Court Judges Association.

Michael Braun and Quan Nguyen Join Foulston Siefkin’s Wichita Office

WICHITA, Kan. – Michael Braun and Quan Nguyen are the newest attorneys to join Foulston Siefkin’s litigation practice group in the Wichita office. Michael and Quan both represent clients in commercial and civil litigation.

Michael graduated magna cum laude from Washburn University School of Law, where he participated in the Washburn Law Clinic in the area of criminal justice. He was selected by faculty to mentor first-year law students and served as an Academic Fellow. Michael earned a Bachelor of Arts in Political Science cum laude from Kansas State University. His experience includes a summer associateship at Foulston, and he has served as a clerk and intern at two other private practice firms.

Quan earned his Juris Doctor from the University of Kansas School of Law, where he graduated Order of the Coif. In law school, he served on the Moot Court Council, provided pro bono legal services with the Douglas County Legal Aid Clinic, and was a teaching and research assistant for several classes. He graduated summa cum laude with a Bachelor of Arts in Political Science from Washburn University, where he was named a finalist for the Sibberson Award. While at Washburn, Quan worked as the head coach and director of a local high school speech and debate team.

Supreme Court to present Justice Award to John Peck 

TOPEKA—The Kansas Supreme Court will present a Justice Award to John Peck, Connell Teaching Professor Emeritus of Law at the University of Kansas School of Law, for his significant contributions to the improvement of justice in Kansas over the course of his career.

The Supreme Court will meet in a special session to present the award to Peck at 1:30 p.m. Wednesday, September 17, in the Supreme Court courtroom in the Kansas Judicial Center.

Choosing Peck for Justice Award 

Chief Justice Marla Luckert said Peck has had a lasting influence on water law education and water law itself.

“If you handle water law cases in Kansas, odds are you’ve sat in John Peck’s classroom, studied one of his many law journal articles, or both,” she said. 

Luckert said water’s vital role in Kansas makes understanding laws that govern it essential education for attorneys.

“Water affects every part of our lives and our economy, from individuals and communities to industry, utilities, recreation, and wildlife,” she said. “When there’s a dispute over water rights, Kansans need attorneys who understand the nuances of water law to represent them in court.”

Peck’s journey through water law

Peck grew up in Concordia, Kansas. After graduating from the University of Kansas School of Law in 1974, he entered private practice at Everett, Seaton & Peck, Attorneys at Law, Manhattan, Kansas. In 1978, a chance phone call changed his career path.

“The dean at KU Law, Martin Dickinson, asked me if I’d join the faculty,” Peck said. After talking it over with his wife, they decided he should interview.

Peck got the job and headed to KU to meet Dickinson. When Dickinson asked Peck what subjects he’d like to teach, Peck responded he’d prefer teaching classes in contracts, land transactions, and family law, areas he was familiar with through his private practice. Dickinson asked him to teach water law as well, and he agreed to teach that course.

Peck joined the KU Law faculty in fall 1978 and taught his first class on water law in spring 1979. He taught his final water law class 41 years later in 2019.

“It became my bread and butter,” he said. “I’ve trained other lawyers, written articles, and helped draft legislation, all in water law.”

Importance of water law

Peck also taught courses in contracts, family law, and land transactions, three subjects he said overlap with water law.

“Water rights are closely associated with property, so there can be water issues in land sales, family disputes over land, and even divorce and family law,” he said.

Peck also began consulting, which he said helped him with publishing law articles and teaching. His experience in the subject led to him to give talks on water law across Kansas and around the world, including in Japan, India, Turkey, Austria, and Canada.

He has also testified before the Kansas Legislature on water issues, co-authored a report on recommended revisions to the Kansas Water Transfer Act, wrote early versions of the Kansas Water Assurance Program Act, and drafted early revisions to the State Water Resources Planning Act.

He wrote the water law chapter for the first Kansas Bar Association Annual Survey of Law. The survey examines changes to areas of Kansas law over the previous year. Peck would end up writing that chapter for 30 years and he used those chapters as a resource.

About the Justice Award 

The Supreme Court presents the Justice Award to recognize individuals or organizations that have made significant contributions to the improvement of justice in Kansas. As a recipient, Peck will receive a plaque and a $500 stipend, and his name will be added to the permanent list of recipients displayed outside the Supreme Court courtroom in the Judicial Center.

The award stipend comes from earnings on a $10,000 check awarded by the Foundation for the Improvement of Justice to the Supreme Court for its program to shorten the amount of time it takes to dispose of a case through Kansas courts. Kansas was the first state to establish specific time standards for each of five major case categories.

Any Kansan or Kansas organization is eligible to receive the Justice Award, except Supreme Court justices, their personal staff, and members of the Justice Award Nominating Committee.

Attorney Noah Hahs Joins Hirsch Abbott Law

Noah Hahs, a Kansas City native and former Kansas Legal Services attorney, is the new assistant county attorney for four (4) counties and assistant city attorney for the roughly eighteen (18) cities in the region that Hirsch & Abbott Law serves. With a diverse background in civil law, Noah is excited to serve his new community.

After growing up in the Kansas City area, Noah attended the University of Kansas, where he earned a degree in human biology. A love for skiing and the outdoors then led him to Steamboat Springs, Colorado, where he spent four years working in various front-of-house positions at restaurants and country clubs.

Returning to Kansas, Noah pursued his law degree at Washburn University School of Law, graduating in 2019. After a brief period at a Kansas City law firm that closed during the COVID-19 pandemic, he moved to Dodge City to work for Kansas Legal Services. This role provided experience in a wide array of legal issues, including but not limited to, family law, elder law, landlord/tenant law, expungements, and driver’s license restoration.

Kansas Reflector senior reporter named to Kansas Press Association hall of fame

Journalism group honors Statehouse veteran Tim Carpenter

TOPEKA — Longtime Kansas journalist and Kansas Reflector senior reporter Tim Carpenter has been selected for a statewide hall of fame honoring journalists. Reflector opinion columnist, nonprofit executive and author Mark McCormick was also named to the hall.

The Kansas Press Association announced the inductees Friday. Carpenter and McCormick were two of seven additions this year to its Newspaper Hall of Fame, in addition to four inductees for the Kansas Photojournalism Hall of Fame.

Carpenter, 64, has been the senior reporter for Kansas Reflector since its inception in 2020. Previously, he spent 15 years each at the Topeka Capital-Journal and the Lawrence Journal-World. He began his roughly 40-year career with United Press International in Topeka. He earned an agricultural journalism degree from Kansas State University.

“I’m excited to join a compelling group of hall of famers,” Carpenter said. “I’ve looked up to many of them during nearly 40 years of Kansas journalism that felt equal parts grinding work and delightful continuing education for my mind.”

Kansas Reflector editor Sherman Smith called Carpenter a “generational icon” who has been “revered and feared as an investigative and political reporter.”

The two have worked together for more than 20 years, beginning in the Topeka Capital-Journal newsroom. Smith said he looked to Carpenter for mentorship.

“There was no story too big — an attorney general’s sex scandal, a governor’s ‘prairie hellion’ of a brother — or beneath him,” Smith said. “College professors showed their students the video of Tim’s shakedown of a political candidate who had mocked patients’ X-rays. Some of the state’s most powerful people wouldn’t speak to the editorial board without knowing whether Tim would be there.”

Carpenter has won the Kansas Press Association’s Victor Murdock Award six times. The William Allen White Foundation honored him four times with its Burton Marvin News Enterprise Award. The Kansas City Press Club has twice presented him with its Journalist of the Year Award and, more recently, with its Lifetime Achievement Award.

“Tim worked selflessly to advance the skills and careers of numerous reporters. I abandoned my editing post at the newspaper for the opportunity to report alongside Tim from the Statehouse, where he taught me political reporting and helped me understand the bewildering legislative process,” Smith said.

Smith said upon launching Kansas Reflector five years ago, Carpenter was the first person he called to join the team.

“He agreed while other veteran journalists thought it was a crazy idea,” Smith said. “Here, he has continued to write compelling news stories of public interest — a university president’s academic integritythe police raid on a small-town newspaper — and helped build Kansas Reflector into a model for a new generation of journalists to do the same.”

Elliott Law LLC Hosts Chamber Connection and Ribbon Cutting

McPHERSON, Kan. — McPherson Chamber of Commerce held a Chamber Connection and Ribbon Cutting at Elliott Law LLC on Thursday, Aug. 14. 

Elliott Law LLC is owned by Ann Elliott, a McPherson native who worked for Wise & Reber L.L.C. for several years before deciding to start her own practice in April. 

“I just decided it was a good time for a change and wanted to try something new and be on my own,” Elliott said.

Elliott shared that the practice is 40-50 percent Family Law. Elliott also practices in Client Advising, Civil Litigation, Healthcare Law, and Municipal Law.

In high school, Elliott was on the debate team and also worked for a number of years at Wise & Reber, which went by the name of Bremyer & Wise, L.L.C. at the time.

She discovered she really enjoyed law after shadowing and working with Brett Reber and David Harger.

“When I went to college, I took a class for teaching and then decided I am not patient enough to do that,” Elliott shared. “So law school it was.”

Elliott earned her Bachelor of Arts in English and Political Science from Rockhurst University in 2009, followed by her Juris Doctor from the University of Kansas School of Law in 2012, graduating with honors. ​

Mayor Tom Brown spoke at the ribbon cutting, adding that for years Wise & Reber was the City Attorney, and Elliott was the Assistant City Attorney under Wise & Reber.

Jeff Houston, former city attorney decided to step down from his role after 30 years in law. He is now a social studies teacher at McPherson Middle School. Since Houston’s departure, Elliott has taken the role as city attorney.

“She’s doing a great job for us and the community and I know that there are bigger and better things yet to come,” Brown said.

Elliott Law Legal Assistant Mena Santangelo was given accolades from both Elliott and Mayor Brown.

“Without her this would not be possible,” Elliott said. “She keeps everything organized and everybody going.”

Foulston Siefkin LLP Adds Paul Breer in Kansas City Office

OVERLAND PARK, Kan. – Special counsel Paul Breer has joined Foulston Siefkin LLP’s litigation practice in the firm’s Kansas City office, deepening the firm’s construction and litigation team.

Paul, an attorney with significant experience in construction disputes, focuses on construction law, civil and commercial litigation, and defense of professional malpractice. He has handled disputes in federal, state, and appellate courts. Before entering private practice in Kansas City, Paul interned for the Hon. Judge Joseph Ellis in the Missouri Court of Appeals. Paul’s experience has been recognized by his peers, and he was selected for inclusion in Best Lawyers: Ones to Watch in America® for 2021-2025 in the areas of Construction Litigation, Medical Malpractice Law, and Personal Injury Defense. Additionally, Missouri & Kansas Super Lawyers® named Paul to the “Rising Star” list for 2022-2024 in the area of Civil Litigation.
