The Kansas Guardianship, Conservatorship, and Other Protective Arrangements Act (the “Act”) goes into effect on January 1, 2026, resulting in significant changes to the current guardianship and conservatorship statues in Kansas. 

The Kansas Bar Association has prepared this guide to help Kansas Lawyers navigate KBA CLE programming and other available resources.

Section 1: What practice areas are impacted?

The Act is far reaching. If you practice in one of the following areas of law, the changes could impact you:

  • Real Estate, Probate, and Trust law: If you are practicing in this area, the information shared in this webinar will likely be vital to your daily practice.
  • Health law: Hospitals and medical professionals should be aware of the end-of-life decision making by adult guardians.
  • Elder law: A protective arrangement may include preventing a person from contacting the respondent to avoid financial abuse.  Also, the Act contains specific end-of-life decision making for adults subject to guardianship. 
  • Family law: Family law attorneys may be impacted by the guardianship rules, especially in difficult divorce situations where minor children are involved and a guardian is required.
  • Banking law: Use of protective arrangements instead of conservatorships may impact how bankers provide access to bank accounts.
  • Business law: A protective arrangement could impact parties to business contracts.  An owner of a business could be an individual subject to a protective arrangement or conservatorship.
  • Agricultural law: Use of protective arrangements instead of conservatorships could impact agricultural contracts.
  • Oil and Gas Law: Use of protective arrangements instead of conservatorships could impact oil and gas contracts and leases.
