As Legislative Services Director for the Kansas Bar Association, I’ve witnessed firsthand the impact strategic lobbying has on members. Advocacy is not just about influencing legislation; it is about safeguarding the values that uphold the legal profession and the rule of law. Through our lobbying efforts, we aim to enhance judicial independence, ensure access to justice, and promote access to the courts. These efforts benefit not only KBA members but also the clients they serve and the public at large.
KBA Legislative Review Process
Each year numerous KBA members, Kansas lawyers, and some laypersons reach out to the KBA with a question about a law or a belief that a statute can be improved upon or streamlined. The KBA has an obligation to its members and to the citizens to review these requests and make recommendations to the Kansas Legislature should these proposals prove to be grounded in fact and supported by legal experts.
The KBA relies upon our 25 sections to review these proposals. Our sections include nearly all areas of the law from Banking to Wills, Immigration and Tax law. Our sections are comprised of lawyers who focus on that area and wish to improve upon that area of the law. Once a proposal, whether originating with the Section or being considered by the section, is approved, the proposal is forwarded to the KBA Legislative Committee.
The KBA Legislative Committee is responsible for reviewing and recommending the legislative agenda to the KBA Board of Governors. This 32-person committee meets in November to recommend proposals for the next following year. The committee is comprised of section liaisons who can discuss with great detail and accuracy the proposals being considered. This committee also hears from other legal groups who wish to receive KBA support for their legislative proposals. The KBA routinely meets with the Kansas Supreme Court, Board of Indigent Defense Services, and Kansas Legal Services. The goal of the Legislative committee is to recommend proposals that support the KBA’s mission of judicial independence, access to justice and judicial efficiency.
Judicial Independence: The Cornerstone of Justice
The independence of the judiciary is fundamental to a fair and impartial legal system. As political pressures threaten to encroach on judicial processes, the KBA serves as defender of judicial independence and separation of powers. Our lobbying efforts advocate for merit-based judicial selection process for appellate courts, proper judicial funding, and the protection of judges from political retaliation.
Judicial independence ensures that legal decisions are based on the law and not on external influences. This benefits lawyers who can trust the system to provide a level playing field for their cases, and it strengthens public confidence in the courts.
Access to Justice: A Shared Responsibility
Every Kansan deserves access to legal representation and the courts, regardless of their socioeconomic status. Lobbying for legislation that funds Kansas Legal Services programs, Indigent Defense Services and expanded pro bono opportunities reduces barriers for our clients which is central to our advocacy.
For KBA members, this means fewer clients turned away due to a lack of resources and greater professional opportunities to serve underserved communities. By promoting access to justice, we align with the values that drew many of us to the legal profession in the first place: fairness and equality under the law.
Access to the Courts: Maintaining the Gateway to Justice
Court accessibility is vital for lawyers and their clients alike. From securing funding for courthouse improvements to advocating for policies that reduce filing backlogs, our lobbying efforts work to ensure that the courts remain efficient and open to all.
These efforts not only help lawyers navigate the judicial system more effectively but also enhance the public’s ability to resolve disputes and seek redress. Ensuring timely and fair hearings strengthens the rule of law and preserves public trust in the legal system.
The KBA as an Information Hub
In addition to direct advocacy, the KBA plays a vital role as an information provider. Through legislative alerts, policy updates, and continuing legal education, we ensure our members are well-informed about the issues affecting their practice and their clients. Our members rely on us to translate complex legislative developments into actionable insights, empowering them to navigate a shifting legal landscape confidently. As director of Legislative Services, I routinely provide CLE opportunities to local bar associations.
